One decade of the European Regulation 1346/2000: what should/could be improved?

This working session is destined to litigators and insolvency lawyers who are familiar with the EU Insolvency Regulation 1346/2000. The European Insolvency Regulation 1346/2000 celebrates its tenth year of entry into force in 2012. The season is right to harvest the most interesting pieces of case law from the European Court of Justice and from national courts and tribunals in and beyond Europe. Before doing so, we want to make an inventory of the available regulations in your countries on this topic, as well as the principles underlying this regulation. This allows off setting the European experience against solutions that have been found in other countries around the world. From what we have learned, we will look ahead to what substantive Insolvency Law should be in the future. The UNCITRAL Legislative Guide on Insolvency Law aims to harmonize, without passing a treaty, the insolvency law throughout the world. We provide you with an opportunity to get acquainted with this novel instrument and the principles on which it is founded.
